What is Mediation?

Mediation is a non-adversarial process which requires the consent of both parties. The goal of Mediation is to help the parties negotiate and reach an agreement on their own. The Mediator makes suggestions and observations, but does not create or dictate the terms of the parties’ agreement.

How Does Mediation Work?

The parties will meet with Karen, who will act as the neutral Mediator. She will help the parties agree to a resolution of their divorce-related issues. Any agreement between the parties can be incorporated into their divorce decree.

The goal of the mediation process is to reach a Property Settlement Agreement, which Karen will draft for you. The Property Settlement Agreement (PSA) is the operative document in a divorce. It contains all the relevant terms, such as equitable distribution of property, child and spousal support, and custody.

Steps of The Divorce Mediation Process

01. Initial Consultation

The first step in the mediation process is an initial consultation.  Both parties attend this meeting and all subsequent sessions.  As Mediator, Karen will provide an orientation and overview and answer any questions either party has about the mediation process.

02. Mediation Sessions

 

After the initial consultation, the parties will begin mediation.  Mediation sessions generally last one to two hours.  At each session, both parties will have the opportunity to work together, with the Mediator’s guidance, to refine the details of child custody, finances, and any other conditions unique to your situation. 

Each session is conducted in a respectful and cooperative atmosphere so that both parties will leave knowing that their wishes, questions, and concerns have been heard and addressed.

03. Divorce Resolution

 

During the mediation sessions, we will also review the legal process of divorce.  As a licensed attorney who has practiced Family Law for over 29 years, Karen will answer your procedural questions and coordinate with any private attorneys retained by the parties.  The Property Settlement Agreement drafted and signed during mediation will be incorporated into the Final Divorce Decree and become an enforceable Court Order which both parties are required to follow.

04. Modification

Circumstances can change.  At any time, the parties have the option to return to mediation to modify their agreement.  The process is the same.  Both parties meet with the Mediator to discuss the changed circumstances and work together to resolve any issues.  The Modification Agreement would be drafted by Karen and filed with the Court.  The Modification Agreement will also be incorporated into the Final Divorce Decree and become an enforceable Court Order.
